Promotional Terms & Conditions

3 Months for £1 Offer — New Customers

These Promotional Terms & Conditions (“Promo T&Cs”) apply to the Klowdfone “3 Months for £1” offer and should be read alongside Klowdfone’s standard Terms & Conditions, which are incorporated herein by reference and available at klowdfone.com/terms-conditions. In the event of any conflict between these Promo T&Cs and the standard Terms & Conditions, these Promo T&Cs shall prevail in respect of the promotional offer only.

 

1. The Offer

1.1  Klowdfone (“we”, “us”, “our”), a trading name of Microcare Systems Limited (registered in England and Wales, company number 03204267), offers eligible new customers access to the Klowdfone hosted VoIP service at a promotional rate of £1.00 + VAT per user, per month for the first three (3) calendar months of a new 12-month contract (“the Offer”).

1.2  The Offer is available on an ongoing basis and may be withdrawn at any time. Any withdrawal will not affect customers who have already signed up under the Offer and whose contracts are in force at the date of withdrawal.

1.3  The Offer is subject to availability and to these Promo T&Cs.

 

2. Eligibility

2.1  The Offer is open to new business customers only. For the purposes of these Promo T&Cs, a “new customer” is any business or individual that:

• does not currently hold an active Klowdfone account; and
• has not held an active Klowdfone account at any point in the 12 months preceding the date of sign-up.

2.2  Existing Klowdfone customers and those who have previously held a Klowdfone account within the last 12 months are not eligible.

2.3  Klowdfone reserves the right to verify eligibility and to decline applications that do not meet the criteria set out in this clause 2.

 

3. Included Services & Exclusions

3.1  The promotional rate of £1 + VAT per user, per month covers:

• The Klowdfone hosted VoIP service (standard features);
• User licences for the duration of the promotional period;
• Included calls as per the standard Klowdfone service plan.

3.2  The following are not included within the promotional rate and will be charged separately at standard rates:

• IP handsets, desk phones, or any other hardware;
• Call charges in excess of the included calls allowance;
• Premium features, add-on services, or upgrades not forming part of the standard plan;
• One-time number porting, setup, or provisioning fees (where applicable).

 

4. Pricing & Payment

4.1  The promotional rate is £1.00 + VAT per user, per month for the first three (3) months of the contract, calculated from the Service Start Date as notified in the Order Confirmation.

4.2  From month four (4) onwards, standard pricing of £13.00 + VAT per user, per month will apply automatically. No further action is required from the customer for pricing to revert to the standard rate.

4.3  All prices are exclusive of VAT, which will be charged at the prevailing UK rate (currently 20%) and added to all invoices.

4.4  Payment terms, invoicing, and overdue account provisions are governed by clause 4 of Klowdfone’s standard Terms & Conditions.

 

5. Contract Term & Commitment

5.1  The Offer is only available to customers entering into a minimum 12-month contract term (“Minimum Term”), as defined in Klowdfone’s standard Terms & Conditions.

5.2  The Minimum Term begins on the Service Start Date as set out in the Order Confirmation.

5.3  Upon expiry of the Minimum Term, the contract will automatically renew for successive 12-month periods in accordance with clause 3 of Klowdfone’s standard Terms & Conditions, unless either party gives at least ninety (90) days’ written notice prior to the end of the then-current term.

5.4  Where the customer qualifies as a Small Business Customer (as defined in Klowdfone’s standard Terms & Conditions), renewal will only occur with that customer’s express consent.

 

6. Cancellation & Early Termination

6.1  Customers may cancel the contract without penalty within ten (10) working days from the date they agree to proceed (“Cooling-Off Period”), other than in respect of charges already incurred pursuant to clause 10.6 of the standard Terms & Conditions.

6.2  After the Cooling-Off Period, if the customer cancels the contract prior to the expiry of the Minimum Term, early termination charges will apply as set out in clause 5(f) of Klowdfone’s standard Terms & Conditions. These include:

• Line rental charges for the remainder of the Minimum Term;
• Any accrued call charges to the date of termination;
• 25% of projected call charges for the remaining Minimum Term; and
• An administration fee of £70.00 + VAT.

6.3  The right to cancel early without penalty also applies in the circumstances set out in clauses 5(c)(i)–(v) of the standard Terms & Conditions (including material breach by Klowdfone not remedied within 30 days, and insolvency of Klowdfone).

6.4  Cancellation requests must be submitted in writing to Klowdfone at: hello@klowdfone.com or by post to The Exchange, 5 Bank Street, Bury, BL9 0DN.

 

7. Redemption

7.1  To redeem the Offer, eligible customers should contact Klowdfone by:

7.2  When making contact to redeem the Offer, customers are asked to reference quote code ‘KF3FOR1’ to ensure the promotional rate is correctly applied.

7.3  The Offer is subject to completion of Klowdfone’s standard sign-up and credit processes. Klowdfone reserves the right to decline applications at its discretion.

 

8. General

8.1  These Promo T&Cs are supplemental to and should be read alongside Klowdfone’s standard Terms & Conditions, available at klowdfone.com/terms-conditions. All other provisions of the standard Terms & Conditions remain in full force and effect.

8.2  Klowdfone reserves the right to amend or withdraw the Offer at any time. Amendments will not affect customers who have already signed up and whose contracts are in force at the date of amendment.

8.3  Klowdfone may vary the standard pricing applicable from month 4 in accordance with clause 4(e) of the standard Terms & Conditions, subject to providing the customer with written notice.

8.4  This Offer is not transferable, cannot be combined with any other promotion or discount, and has no cash equivalent.

8.6  These Promo T&Cs and any dispute or claim arising out of or in connection with them shall be governed by the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the English courts.
